Terms of Use for Modir Auto-École

Please read these Terms of Use ("Terms") carefully before using the Modir Auto-École website (https://modirautoecole.com/) and our mobile and web application (collectively, the "Service") operated by Modir Auto-Ecole ("we," "us," or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. The Service

Modir Auto-École provides a cloud-based management platform for driving schools to manage student profiles, track payments, monitor progress, and generate receipts ("Service"). The Service is accessible via our website and mobile applications.

2. Accounts and Subscription

  • Account Registration: You must register for an account to access the core features of the Service. You agree to provide accurate, current, and complete information during the registration process.
  • Subscription: The Service is provided on a paid subscription basis ("Subscription"). You must have an active Subscription to use the Pro features, including cloud sync and multi-platform access. We may offer a free trial, after which you will be billed in advance on a recurring and periodic basis (e.g., monthly or annually).
  • Payment: You agree to pay all fees associated with your Subscription. All fees are non-refundable except as required by law or as stated in our [Money-Back Guarantee, if any].
  • Cancellation: You may cancel your Subscription at any time. Your access to the Pro features will continue until the end of your current billing cycle.
  • Non-Payment: If you fail to pay your Subscription fees, we reserve the right to suspend or terminate your account and access to the Service.

3. User Responsibilities (Your Data)

You are solely responsible for all data, information, and content (collectively, "User Data") that you upload, enter, or otherwise transmit via the Service.

  • Data Ownership: You retain all ownership rights to your User Data. We do not claim any ownership over it.
  • Legal Compliance: You represent and warrant that you have all necessary rights, consents, and permissions to collect, share, and use all User Data as contemplated by the Service. This includes, but is not limited to, obtaining explicit consent from your students to store and process their personal and financial information within the app.
  • Acceptable Use: You agree not to use the Service to:
    • Upload any data that is unlawful, harmful, or infringes on any third party's rights.
    • Impersonate any person or entity.
    • Attempt to gain unauthorized access to the Service, our servers (hosted on Firebase), or other user accounts.
    • Reverse engineer or decompile any part of the Service.

4. Intellectual Property

The Service and its original content (excluding User Data), features, and functionality are and will remain the exclusive property of Modir Auto-Ecole and its licensors. The Service is protected by copyright, trademark, and other laws.

5. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms (e.g., for non-payment).

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply cancel your subscription and discontinue using the Service. We reserve the right to delete all your User Data from our systems after a certain period following termination.

6. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, that the Service will be uninterrupted, error-free, or 100% secure. While we use secure cloud infrastructure (Firebase) for data storage and sync, we are not responsible for any data loss or corruption.

7. Limitation of Liability

In no event shall Modir Auto-Ecole, nor its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or other intangible losses, resulting from (i) your access to or use of, or inability to access or use, the Service; (ii) any unauthorized access to or use of our secure servers and/or any personal information stored therein.

Our total liability to you for all claims arising from the Service is limited to the amount you paid us for the Service in the six (6) months preceding the claim.

8. Governing Law

These Terms shall be governed in accordance with the laws of the Kingdom of Morocco, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice prior to any new terms taking effect.
